Rental Agreement
This agreement is made between Karen & Co. ("we", "us", "our") and the hirer ("you", "your"). By signing on Booqable or on a rental document, you agree to all of the terms set out below.
Before booking, please also read our Terms & Hire Conditions, which cover cancellation policy, driver requirements, what's included, and collection and return details.
1. Your undertakings
By entering into this agreement, you agree to:
- Use the vehicle only within Great Britain and Ireland, unless authorised otherwise by us in writing.
- Not load the vehicle in excess of its carrying capacity or weight limit.
- Not carry more passengers than the seating capacity of the vehicle.
- Not use the vehicle to carry or store products that may cause damage.
- Keep the vehicle locked when unattended and take all reasonable steps to prevent loss or damage to the vehicle, its tyres, tools, accessories, equipment or contents.
- Inform us immediately if the vehicle develops any fault or requires servicing, and permit us to carry out any essential repairs.
- Ensure the gas canister valve is closed when the vehicle is in transit.
- Not alter the vehicle's specification, paintwork or markings.
- Maintain the vehicle in a clean and roadworthy condition throughout the hire, including checking tyre pressures, engine oil, battery fluid, screen wash, coolant and automatic transmission fluid (where fitted).
- Notify us promptly of any defects, and immediately of any defect affecting roadworthiness.
- Notify us immediately of any incident involving loss or damage to the vehicle, and complete an Accident Report Form with witness details where required.
- In the event of an accident, obtain the names and addresses of all drivers and witnesses, secure the vehicle, and notify the police where appropriate.
- Make the vehicle available at a reasonable time and place for us to carry out repairs or replacements as required.
- Not sell, charge, lend or re-hire the vehicle.
- Reimburse us within 14 days for any taxes, fines, customs duties or charges levied on us as a result of your use of the vehicle.
- Check the vehicle at the start of hire to confirm it is fit for purpose and in good condition. In the absence of any defect being confirmed to us in writing before hire begins, you are deemed to accept the vehicle as fit for purpose and in good condition.
- Return the vehicle to our collection location at the end of the hire period in the condition it was in at the start of hire (fair wear and tear accepted), clean and tidy (traffic grime accepted). If the vehicle is not returned to our location, you will be liable for the cost of arranging its return.
- Pay all applicable hire charges, fuel costs, and any charges for accessories, tyres, tools or equipment that are lost, stolen or damaged during the hire.
- Pay any penalties, fines and court costs incurred during the hire period that we are obliged to pay.
- Not use the vehicle for any unlawful purpose, racing, pace making, competitions or speed testing.
- Inform us if you have more than 6 points on your licence. All offences of 6 points or more will require referral to our insurers. You must have no more than one fault or outstanding incident or claim in the last five years.
Personal vehicles left in our yard during the rental period are left entirely at the owner's risk. We are not liable for any damage caused by Karen & Co. employees, customers, or for any other reason.
2. Our undertakings
We will carry out all repairs and replace parts as required to maintain the vehicle in a serviceable and roadworthy condition, and carry out routine servicing and maintenance.
3. Rental period
The rental period runs from the date out shown in your booking until the date due back, unless:
- You terminate the agreement before the date due back, or
- We terminate the agreement before the date due back due to a breach of any term of this agreement, or
- We call for the return of the vehicle before the date due back for any other reason.
In any of these circumstances, you must return the vehicle immediately. You will not be liable for charges relating to any period after the vehicle has been returned.
If you breach this agreement or the agreed hire period ends and you have not returned the vehicle, normal rental charges will continue to accrue, along with any costs incurred by us in recovering the vehicle.
4. Insurance
Where you have indicated that you wish us to arrange insurance through the Alan Boswell Group, the following applies:
- This agreement is subject to the terms, conditions and limitations of our insurance policy, a copy of which may be inspected at our collection location.
- The vehicle may only be driven by you, the person signing the agreement on your behalf, or any additional authorised drivers who have our consent.
- You agree to pay the applicable insurance charges and the stipulated excess of £1000 in the event of an accident, unless you have paid for the insurance excess cover (£15 per day).
- You will compensate us for any loss, whether direct, indirect or consequential, arising from any act or omission by you, your servants or agents.
We will insure the vehicle under a comprehensive motor policy. You will be responsible for:
- The accidental damage excess shown in the rental agreement.
- All loss or damage and associated liabilities if the vehicle is driven by a person not licensed to drive it, or if you are in breach of any terms of the policy.
- The cost of repair for any damage resulting from wilful action by you or your agents, even where covered by our insurance.
Alternatively, you may arrange your own comprehensive motor policy, which must note our interest as the owner of the vehicle, provide us with an indemnity against liabilities arising from use of the vehicle, and direct all claim payments relating to loss or damage to us.
You agree to indemnify us against all claims, costs and liabilities arising from your possession or use of the vehicle that are not covered by the relevant insurance policies. We are not responsible for goods carried in or on the vehicle.
5. Payment terms
- No credit facilities are offered. Full payment is required at the time of booking.
- Full payment must be received at least 2 weeks before the rental start date.
- A £300 security deposit will be captured by card on the day of collection.
- The deposit will be returned in full within 10 days of return, provided the vehicle is returned without damage and with the correct fuel level.
- We reserve the right to capture funds from the card on file if the vehicle is not returned in the appropriate condition.
- If the vehicle is returned with less than a quarter tank of fuel, an automatic £30 charge will be applied.
6. Legislation
You are liable as the operator of the vehicle in respect of:
- Any fixed penalty offence committed under the Road Traffic Offenders Act 1988, the Road Traffic Act 1991, or equivalent legislation applicable in Scotland, Northern Ireland or any British Isle where the vehicle is used.
- Any excess charges under the Road Traffic Regulation Act 1984 or equivalent legislation.
- Any financial penalty or charge arising from the vehicle being parked on private land.
7. Consequential loss
We will not under any circumstances be liable for any direct or indirect consequential loss arising from the hire of the vehicle, however caused, including any negligent act or omission on our part.
8. Loss of use
If the vehicle is stolen, lost, seized, confiscated, or returned in a damaged condition (fair wear and tear accepted), and you have arranged your own insurance, we reserve the right to charge you compensation for loss of use.
9. Performance
We will be relieved of our obligation to provide the vehicle where its use is prevented by fire, explosion, flood, strike action, or any cause beyond our reasonable control.
10. Law
The laws of the country in which this agreement is signed apply. Any legal proceedings will be conducted in the same jurisdiction.
You acknowledge that:
- This agreement is not assignable by you.
- This document contains the entire understanding between both parties. No additions or alterations are valid unless made in writing and signed by an authorised officer of Karen & Co.
- You are not entering into this agreement on the basis of any warranty or representation by us.
- Our failure to enforce any term of this agreement does not constitute a waiver of our rights.
Damage charges
If damage is caused to the vehicle during the hire period, the following charges apply:
